16 Payment Terms

Please read these Payment Terms carefully before making or receiving payments for services on or through the Site. By making or receiving payments for services offered on or through the Site, you consent and agree, on your own behalf or on behalf of your employer or any other organization, to be bound by and comply with these Payment Terms. These Terms are supplemental to Nanoinfluencerspower.com's general Terms of Service (collectively, the "Terms of Service").

16.1. Key Terms

Capitalized terms used but not defined herein shall have the meanings set forth in the Terms of Service.

The Nanoinfluencerspower.com Balance is the total amount of Freelancer Earnings and/or refunded payments for canceled orders as a Client.

Payment Service Providers are service providers that provide payment services to Clients and Freelancers in connection with the Site. These services include the collection of funds from Clients in connection with purchases, remittances and withdrawals of funds by and from Freelancers, as well as currency exchange services in connection with payments and withdrawals in local currency, and management of Nanoinfluencerspower.com Balance funds.

Earnings are the revenues obtained by the Freelancer on Nanoinfluencerspower.com, and may be withdrawn or used to make purchases through the Site, pursuant to these Terms.

16.2. Receiving Payments

16.2.1 General

• Every Service sold and properly completed by a Freelancer results in an accreditation to their account of Earnings equal to 90% of the purchase amount.
• Freelancers are responsible for paying any direct or indirect taxes, including Goods and Services Taxes, VAT, or income taxes, owed by them depending on their residence, domicile, or otherwise, in accordance with local jurisdiction. Freelancers represent and warrant that they comply, and will continue to comply at all times, with their obligations under the income tax regulations in their jurisdiction. The price indicated on the Service Page, or otherwise agreed upon between the Freelancer and the Client, is inclusive of all taxes and charges that may apply to the Freelancer.
• Appointment as Limited Payment Collection Agent: Payment Service Providers simplify payments to Freelancers. Where Nanoinfluencerspower.com receives funds, the Freelancer agrees that Nanoinfluencerspower.com does so as an agent. The Freelancer therefore appoints Nanoinfluencerspower.com as its limited payment collection agent, solely for the purpose of accepting payments (via its Payment Service Provider, where applicable) from the Client and remitting those payments to the Freelancer. The Freelancer agrees that payment made by the Client to Nanoinfluencerspower.com shall be considered equivalent to a payment made directly to the Freelancer. The Client's payment obligation to the Freelancer shall be deemed fulfilled when Nanoinfluencerspower.com, through its Payment Service Providers, receives the Client's payment, and Nanoinfluencerspower.com, through its Payment Service Provider, where applicable, is responsible for remitting the funds to the Freelancer in the manner set forth in these Payment Terms. If Nanoinfluencerspower.com (through its Payment Service Providers) fails to remit amounts due to the Freelancer, the Freelancer will have recourse only against Nanoinfluencerspower.com and not directly against the Client. The Freelancer agrees that Nanoinfluencerspower.com may include or otherwise reflect these terms in any form of terms of service, receipts, disclosures or notices, including, but not limited to, receipts provided to Clients by Nanoinfluencerspower.com as deemed necessary or prudent.
• Nanoinfluencerspower.com is not a Payment Service Provider. Nanoinfluencerspower.com works with various Payment Service Providers in order to collect payments from Clients, transfer those payments from Clients to Freelancers, and hold funds in relation to Nanoinfluencerspower.com Balances. None of the above payment services are performed by Nanoinfluencerspower.com itself. Furthermore, all payment services related to the withdrawal of funds from the Site are performed by Nanoinfluencerspower.com's Payment Service Providers and not by Nanoinfluencerspower.com itself. The Freelancer agrees to be bound by any additional terms and conditions provided by a Payment Service Provider, as such terms may be amended by the Payment Service Provider from time to time.

16.2.2 Withdrawing Earnings

• Freelancers can withdraw their Earnings using one of Nanoinfluencerspower.com's withdrawal options (see the Withdrawal Methods section below for withdrawal fees). To withdraw available Earnings, click on the designated withdrawal provider to initiate the withdrawal process.
• Your Nanoinfluencerspower.com profile can be associated with only one account for each withdrawal method on Nanoinfluencerspower.com. Your Nanoinfluencerspower.com profile can be associated with only one withdrawal account of a Payment Service Provider.
• Earnings are made available for withdrawal from the Earnings page only after a 14-day clearance period after the order is marked as complete.
• Nanoinfluencerspower.com may temporarily disable a Freelancer's ability to withdraw Earnings where Nanoinfluencerspower.com determines, in its sole discretion, that such action is reasonable in order to meet legal requirements, prevent fraud, or protect the rights or interests of Nanoinfluencerspower.com or third parties. Non-exhaustive examples of such suspension may occur as a result of security issues, improper conduct reported by other users, or the association of several Nanoinfluencerspower.com accounts with a single withdrawal provider.
• Withdrawals can only be made to the extent of the amount available to you.
• Withdrawal fees vary depending on the method and are set by the Payment Service Providers.
• Withdrawals are final and cannot be canceled. We will not be able to cancel or reverse the procedure after it has been initiated.
• Freelancers can indicate a bank account where to deposit their earnings or a PayPal account.
• Freelancers may withdraw their Earnings from a disabled account after a 90-day security period, following full verification of the account ownership in question, from the day of the last payment received on the account and subject to Nanoinfluencerspower.com's approval.

16.2.3 Withdrawal Methods

Below are the available withdrawal methods and the withdrawal fees charged respectively by the Payment Service Providers with whom the Freelancer has chosen to open an account:

• Withdrawal to Pay Account
• Direct Bank Transfer (managed by Stripe) - approximately 3 USD per transfer*.
• The selected Payment Service Provider may apply additional fees based on the User's location and currency.

16.3. Purchases

16.3.1 General

• Clients pay Nanoinfluencerspower.com to create an Order from the Service Page.
• Nanoinfluencerspower.com is not a Payment Service Provider. Nanoinfluencerspower.com works with various Payment Service Providers in order to collect all payments from Clients, transfer those payments from Clients to Freelancers, and hold funds in relation to Nanoinfluencerspower.com Balances. All payment services related to the collection of funds from the Site are performed by the Payment Service Providers and not by Nanoinfluencerspower.com.
• Nanoinfluencerspower.com acts as a limited payment collection agent for the Freelancer, solely for the purpose of accepting payments (via its Payment Service Provider, where applicable) from the Client and remitting those payments to the Freelancer. The Client's payment obligation to the Freelancer shall be deemed fulfilled when Nanoinfluencerspower.com, through its Payment Service Providers, receives the Client's payment, and Nanoinfluencerspower.com, through its Payment Service Providers, is responsible for remitting the funds to the Freelancer in the manner set forth in these Payment Terms. If Nanoinfluencerspower.com (through its Payment Service Provider) fails to remit amounts due to the Freelancer, the Freelancer will have recourse only against Nanoinfluencerspower.com and not directly against the Client. By accepting responsibility as the authorized limited payment collection agent for the Freelancer, Nanoinfluencerspower.com and its affiliates assume no liability for any acts or omissions of the Freelancer.
• In most locations, purchases can be made on Nanoinfluencerspower.com using one of the following payment methods: credit card, PayPal. Additional payment methods may be available in some locations.
• Fees (10%), VAT (22%), the cost of bank transfers (approximately 1%) are added at the time of purchase, when you can review and accept the total amount required for payment.
• The User cannot propose to the Freelancer to be paid or make payments using any method different from the Site. In the event that the User receives a request to use an alternative payment method, they must immediately report it to Customer Service.
• You agree to receive invoices and/or payment receipts from Nanoinfluencerspower.com in electronic format as PDF documents, via email or through the Site.
• To protect against fraud, unauthorized transactions (such as money laundering), claims, or other liabilities, payment information related to withdrawals is collected by Nanoinfluencerspower.com or Nanoinfluencerspower.com's Payment Service Providers. Payment Service Providers may also collect other data necessary to process withdrawal payments. Payment information provided to Payment Service Providers is subject to the Payment Service Provider's Privacy Policy and its terms and conditions.
• By using any payment method and/or providing payment data to make purchases on Nanoinfluencerspower.com, you represent and warrant that: (a) you are legally authorized to provide such data; (b) you are legally authorized or have permission to make payments using the selected method(s); (c) if you are an employee or acting on behalf of a company or person who owns the payment method, you are authorized by such company or person to use that payment method to make payments on Nanoinfluencerspower.com; and (d) such actions do not violate any applicable law.

16.3.2 Currency

• You can pay for services offered on or through the Site and other Orders in different currencies using your PayPal account indicated in the freelancer profile.
• Your Nanoinfluencerspower.com Balance is always valued in EURO.

16.4. Taxes

• Nanoinfluencerspower.com may be required by law to charge indirect taxes to users (such as sales tax, VAT, or goods and services tax) or to withhold taxes. Any amount that Nanoinfluencerspower.com is required to collect will be added to the purchase amount and any other fees owed by the Client, and any amount that Nanoinfluencerspower.com is required to withhold will be deducted from the Freelancer's Earnings, as established by applicable laws.
• Indirect taxes are to be considered in addition to the prices indicated on the Site, and in any case will be shown to the Client before payment.
• Users are responsible for paying any direct or indirect taxes, including Goods and Services Taxes, VAT, or income taxes, owed by them depending on their residence, domicile, or otherwise, in accordance with local jurisdiction.

16.5. Disputes and Cancellations

We encourage Clients and Freelancers to try to resolve any disputes between them. If for any reason this is not possible after using the Resolution Center or if unauthorized use of the Site is found, Users can contact Nanoinfluencerspower.com Customer Service for assistance.

16.5.1 Basics

• Nanoinfluencerspower.com, through its Payment Service Provider, reserves the right to cancel Orders or suspend funds in case of any suspected violation of the law, the Terms of Service, or for fraudulent transactions carried out on the Site.
• The transfer and assignment of intellectual property rights to the Client are subject to full payment by the Client. The Client will not be allowed to use the delivery if payment is canceled for any reason.
• If an order is canceled (for any reason), the funds paid will be returned to the Client's Nanoinfluencerspower.com Balance.
• Revisions to deliveries can be performed by Freelancers based on the Freelancer's Service and customer support. Freelancers can determine the number of revisions they want to offer, which can also be zero.
• It is not permitted to request additional Services from Freelancers, in addition to those requested and agreed upon.

16.5.2 Order Cancellations

• Nanoinfluencerspower.com encourages Clients and Freelancers to resolve disputes between them relating to services using the Resolution Center.
• Eligibility for order cancellation requests by Nanoinfluencerspower.com will be evaluated by Nanoinfluencerspower.com based on any improper conduct, violations of our Terms of Service and/or our Community Standards, and improper use of the Nanoinfluencerspower.com delivery system.
• Completed orders can be canceled, subject to review by our customer support team, based on any improper conduct, violations of our Terms of Service and/or our Community Standards, up to 7 days after the order has been marked as complete. Note that orders cannot be partially canceled (i.e., we can only cancel the entire order, in justified cases).
• In rare cases where deemed appropriate, our Customer Service Team may cancel a completed Order even if 7 days have already passed since its completion.
• Orders cannot be canceled based on the quality of the Service/materials delivered by the Freelancer if the Service was provided as agreed between the Freelancer and the Client. The user can leave a rating for their experience with the Freelancer on the freelancer's personal page, where they can indicate the overall level of quality of the services received.
• Any unauthorized use of Nanoinfluencerspower.com found during an Order, after being examined by our Customer Service Team, may result in the Cancellation of the Order. This includes, but is not limited to, harassment, illicit behavior, or other violations of Nanoinfluencerspower.com's Terms of Service.
• Nanoinfluencerspower.com will cancel Orders, based on, but not limited to, the following reasons:

Active Orders (after the requested Instructions have been sent to the Freelancer and before the Freelancer completes the delivery on Nanoinfluencerspower.com):

• The Freelancer is late and does not respond for more than 48 hours while the Order has been marked as Late through customer service.
• The user is abusive towards the counterparty, threatening to leave a bad rating or exploiting materials related to the order (such as login details, personal information) against the counterparty.
• Users have provided or included materials that violate copyright/registered trademarks in their requested Instructions or in the Freelancer's delivery.
• The user is no longer an active Nanoinfluencerspower.com user due to violations of the Terms of Service or account closure.

Delivered Orders (after the Freelancer has confirmed delivery and requested funds or before the Order is marked as complete):

• The Freelancer communicates an extension of the expected delivery date to complete the requested service without providing the definitive delivered service. NB: in case of repeated infringement reports, the User's account will be permanently suspended.
• The Freelancer does not deliver the files and/or proofs of work related to the agreed requested instructions for the order. NB: the subjectivity of the materials in question will be subject to review by our Customer Service Team.
• The Freelancer requests additional payments, inside or outside the Site, withholding the definitive delivery of the services in direct relation to the agreed requested instructions.
• The Freelancer does not deliver the definitive services pending better ratings.
• Users who abuse requests in addition to those requested and agreed upon.
• Users who threaten to leave a negative review to obtain more services from the Freelancer outside of those requested and agreed upon.

16.5.3 Chargebacks

Nanoinfluencerspower.com reviews chargeback cases from payment service providers and disputes on behalf of Freelancers. Although the results vary from case to case, depending on the reason for the chargeback, we always strive to resolve disputes in favor of the Freelancer. If the chargeback case allows, Nanoinfluencerspower.com, through one of its Payment Service Providers, will return part of the Earnings or the entire Earnings to the Freelancer; otherwise, the chargeback amount will be borne by the Freelancer.

16.5.4. Refunds

• Nanoinfluencerspower.com does not automatically refund payments made for canceled Orders to the User's payment service provider. Funds resulting from the cancellation of an order are returned to the Client's Nanoinfluencerspower.com Balance and can be used for future purchases on Nanoinfluencerspower.com.
• Refunds from the Client's Nanoinfluencerspower.com Balance (i.e., direct refunds to the payment service provider) can be requested from the billing page. The refund will be based on the payment method(s), amount, and currency you selected. To prevent fraud and abuse, we set a minimum limit for performing refunds, which is subject to review by our Customer Service Team. Such refunds may involve an additional cost.
• The Freelancer can offer the Client a partial refund with respect to a specific Order or Weekly Report. Following the Client's acceptance of such partial refund, the amount will be automatically refunded to the payment method used by the Client. If Nanoinfluencerspower.com, through its Payment Service Providers, is unable to refund the agreed amount to the Client's payment method, this amount will be added to the Client's Nanoinfluencerspower.com Balance. In these cases, Customer Service must be informed in advance.

16.6. General Conditions

16.6.1 Changes

• Nanoinfluencerspower.com may make periodic changes to these Payment Terms. Once these changes are made, Nanoinfluencerspower.com will make a new copy of the terms available on this page.
• You understand and agree that if you use Nanoinfluencerspower.com after the date on which the Terms have changed, Nanoinfluencerspower.com will treat your use as acceptance of the updated Terms. If you do not accept the changes to the Terms, the User must deactivate their account.
• Nanoinfluencerspower.com may modify these Terms due to changes in the Site and the customary course of development of our products and Services, changes in any relevant feature or functionality of the Site, changes in circumstances beyond our reasonable control, to adapt to new technologies, and to address legislative and regulatory changes, as well as security and fraud issues.

16.6.2 Applicable Law

Any claims under these payment terms relating to the processing of card transactions and payments will be governed by and interpreted in accordance with Italian laws at the court of Genoa, which the parties agree to consider the sole competent forum.
